These terms govern your use of thebagelboardcompany.com (the "Site") and any purchase from The Bagel Board Company LLC ("we," "our," "us"). By accessing the Site or placing an order, you agree to these terms.
Eligibility
You must be at least 18 years old to place an order. By placing an order, you represent that you are at least 18 and capable of entering into a binding contract.
Products and pricing
We make our best effort to describe our cedar bagel boards, kits, and bagel stands accurately. Because every product is handcrafted from natural cedar, slight variations in grain, color, and dimension are expected and not defects.
Prices are listed in US dollars and are subject to change without notice. The price at the time you place your order is the price you pay; price changes do not retroactively affect orders already placed.
We reserve the right to limit quantities, refuse service, or cancel an order if we identify a pricing or inventory error, suspect fraudulent activity, or are otherwise unable to fulfill the order. If we cancel an order you've paid for, you'll receive a full refund.
Orders and payment
By placing an order, you authorize the charge to your selected payment method for the total order amount, including shipping and any applicable taxes. Payment is processed by Shopify Payments and other payment providers we may add over time; see our Privacy Policy for how payment data is handled.
Shipping and returns
Use of the Site
You agree to use the Site lawfully and in good faith. You will not:
- Attempt to gain unauthorized access to any part of the Site, accounts, or systems
- Use automated means (bots, scrapers) to interact with the Site without our written permission
- Misrepresent your identity, payment method, or shipping address
- Use the Site to transmit malware, harass others, or violate any law
- Reproduce, copy, or republish content from the Site without our written permission
We may suspend or terminate access for any user who violates these terms.
Intellectual property
All content on the Site — text, photos, logos, product designs, and the cedar-board snap-system innovation on our Signature line — is owned by The Bagel Board Company LLC or our licensors. You may not reproduce, distribute, or create derivative works without our written permission. Customer reviews you submit are your own; by submitting, you grant us a non-exclusive, royalty-free license to display them on the Site.
Disclaimer
Our products are designed for home and event use. While we use food-grade burlap, untreated cedar, and food-touch-safe finishes, you are responsible for proper use, cleaning, and maintenance per the care instructions we provide.
The Site and our products are provided "as is." We do not guarantee that the Site will be uninterrupted, error-free, or free of viruses; you access it at your own risk.
Limitation of liability
To the maximum extent permitted by Colorado law, our total liability for any claim arising out of or related to the Site or our products is limited to the amount you paid for the product giving rise to the claim. We are not liable for indirect, consequential, incidental, or punitive damages.
Indemnification
You agree to indemnify and hold harmless The Bagel Board Company LLC and its principal from any claim arising from your violation of these terms, your misuse of the Site, or your violation of any third-party right.
Governing law and jurisdiction
These terms are governed by the laws of the State of Colorado, without regard to conflict-of-law principles. Any dispute arising out of or related to these terms or our products will be resolved in the state or federal courts located in El Paso County, Colorado, and you consent to that jurisdiction.
Changes to these terms
We may update these terms from time to time. The "Last updated" date at the top reflects the most recent revision. Continued use of the Site after a revision constitutes acceptance of the updated terms.
Severability
If any provision of these terms is found unenforceable, the remaining provisions remain in full effect.
Entire agreement
These terms, together with our Privacy Policy, Shipping Policy, and Refund Policy, constitute the entire agreement between you and The Bagel Board Company LLC regarding the Site and our products.
